I apologize for possibly posting this in a non relevant section of the forums, but now on to the bad news. The owner of Arcade Odyssey in Miami, FL recently got a letter from them, below is a summary.


"I thought this might be of interest to all arcade owners out there, I just got a rather interesting email from ASCAP - THE AMERICAN SOCIETY OF COMPOSERS, AUTHORS AND PUBLISHERS - basically they are arguing that I cannot have a dancing game, pinball or any arcade machine that plays any music from any artist listed in their huge repertoire without paying them a royalty per year....
I have reached out to stern and Andamiro since those were 2 that he had mentioned to see what their legal depts. come back with...I will keep all of you posted since it looks like a witch hunt may be developing and I expect many other arcades will begin to receive similar letters shortly..."

Oh god, not this again...Man the ASCAP is really trying to "Double Dip" hard on this! I hope Ricky can resolve this soon, I enjoy Arcade Odyssey too much to see this get screwed up.//

I've heard of another arcade getting a letter like this. If an artiest agrees to have his/her music in an arcade game, then its for public use. With that being said ASCAP doesn't really have much of a fight here. It's likely them trying to scare people because of the music industry making less money.

Not always. The developer needs 3 licenses per song - Public Performance, Publishing, and the third one completely escapes me right now. In this case, ASCAP is going for the public performance license.

How long before they start going after people who don't use headphones/earbuds to listen to music? I mean, they're letting others listen for free! Roll Eyes
