This is the one I'm looking at, but that product doesn't have HDMI support, which I am planning to use. I want to capture footage on my gaming console. If there are other options, can someone notify me?

Look at the Blackmagic Intensity Pro or Shuttle. They support HDMI and work very well.

I believe my laptop doesn't have USB 3.0 (just 2.0). Is that going to be a problem?

On the technical specifications page, it says:
Requires an x58 based motherboard with onboard USB 3.0, or a USB 3.0 PCI Express card and an x58 or P55 series motherboard. Does not support USB 2.0 capture and playback.
So basically yes, it will be a problem if you only have USB 2.0.

Does your laptop have e-SATA? If so, it might be possible to get this capture device to work through e-SATA, if you buy some kind of e-SATA to USB 3.0 converter.It's more likely though that you're out of luck.
