Aside from the fact that it's been around since X CS with the same name... If it was an error, they would've fixed it by now, not continue to include it in games with the faulty title, and especially not continue to use said faulty name in menus and soundtracks and whatnot.
Also considering how replacing "with" with "wit" is not an uncommon thing in the genre or genres like it, it should come as no shocker.
BONUS: Inspiration was typo'd as "Inspriration" when it first came around, so if "in love wit you" was a typo, it would've been fixed alongside that.

The song has been featured in ten different games with three different banner/jacket variants (X, X2, Dance Wars). There would be tons of opportunity to change it, but it's obviously intentional.

To add to the "In Love Wit You" thing - It would have been spelled correctly in the song wheel as they usually typo only the artwork.
